Showmetoo Privacy Policy

For users accessing Showmetoo from the European Union, the EU Digital Services Act (“DSA”) Guidelines also form part of our Terms of Use.

1. Introduction

This privacy policy describes how Showmetoo processes and protects your personal data with regards to the use of our cloud services which store your data (hereinafter referred to as the “Services”). Every Showmetoo user must be at least 18 years old. Further, the words “Showmetoo ”, “we”, “us” and “our” refer to Showmetoo, and “you”, “your”, and “user” refer to you, the user of the Services, and the words “your file”, “your data” or “your files”, “your materials” refer to five types of data that can be uploaded and  saved on Showmetoo cloud servers, namely:

(1) Photographs

(2) Videos

(3) Text and graphic documents, text recordings

(4) Audio files

(5) Account details: email address, username and password

1.1. Data Protection Principles

Showmetoo adheres to two main principles of collecting and processing users' personal data:

· We store only the data necessary for Showmetoo to be a reliable and convenient service for storing our users' files.

· Minimum interference in the user’s use of the application.

1.2. Terms of Use

This Privacy Policy forms part of our Terms of Service, which set out the terms under which you may use our Services, accessible from www.showmetoo.com.  This Privacy Policy should be read together with the Terms of Use. 

1.3. Contents

This Privacy Policy Explains:

· The legal basis for processing of your personal data

· What personal data we may collect from you

· How we protect your personal data

· The purposes for which we process your personal data

· With whom we may share your personal data

· Your rights concerning your personal data

2. Legal Basis for Processing Personal Data

We process your personal data in the context of our legitimate interests, including:

(1) To provide useful and convenient services to our users

(2) To detect, prevent, or otherwise address fraud or security issues related to the provision of Showmetoo Services, except for where those interests are overridden by your interests or rights and freedoms to protect personal information.

3. What personal data do we process?

3.1. Basic account data

The Showmetoo service is a public social network that allows its users to:

Show their location on a public map, see the profiles/accounts of other Showmetoo users within a radius of 0 to 70 meters, and exchange messages and media files with them, even if these users don't know each other.

Publish images and videos with added location (hereinafter referred to as "Posts")

View other users' posts

Follow other users and view their profiles

Save photos and videos, audio files, and certain types of documents (hereinafter referred to as "Files") to the cloud Gallery.

You provide your email address and basic account data, including your profile name, profile photo, and other information to create an Showmetoo account. You can specify your real name or any nickname.

The email address you provide will be used only to log in to the account. It will also be used to recover your password, if you forget it. It will be visible only to you in the profile settings section. The email address for login will be stored until it is changed or the account is deleted.

3.2. Your Files

Showmetoo is a cloud service. We store the files you upload and publish on our servers, so you can access your data from any of your devices at any time without relying on third-party backups.

3.3. Cookies

We only use cookies that are necessary to provide and deliver our services online. The cookies used by Showmetoo are small text files that allow us to provide and customize our services to give you a better user experience. Your browser should allow you to control these cookies, including whether to accept or reject them and how to delete them.

4. Protection of Personal Data   (Storage and Protection of Personal Data)

4.1. Storage of Personal Data

We do not transfer our users' data to any third parties and we do not care what files and data users store in their accounts unless it violates our Privacy Policy and our Terms of Use. If you have registered with Showmetoo from the EEA, your data will be stored in data centers in Germany and/or the Netherlands in encrypted form. Unless otherwise stated in this Privacy Policy, your personal data that we process will only be stored for as long as we fulfil our obligations to provide services.

5. Processing of Personal Data

5.1. Our services

We process and store your personal data so that you can access it from any smartphone on which the Showmetoo application can be installed.

5.2. Security

Showmetoo enables the formation of large communities in profiles, which we must moderate in terms of abuse and violations of the terms of service. To improve the security of your account and prevent spam, abuse, and other violations of our Terms of Service, we may collect and process metadata such as your IP address, the devices you have used, the history of username changes, etc.  If we do collect this datawe store it for no more than 12 months for the above purposes.

5.3. Spam and Abuse

The Showmetoo network is created for people who respect each other and do not wish harm to others; therefore, Showmetoo users are prohibited from propaganda, aiding and dissemination of information, publications, and/or files containing:

· Calls for violence against people and animals, insults, and humiliation of human dignity

· Propaganda of narcotic and intoxicating substances.

· Calls indicating terrorist acts

· Racism, Nazism, incitement of hateful acts

· Signs of pedophilia (sexual harassment of children, incitement of children to actions of a sexual naturechild sexual abuse material (CSAM)

· Trade in weapons and other prohibited goods

· Lies, slander

6. Violation of children's rights

Showmetoo users are prohibited from creating, uploading, or distributing content related to child sexual abuse and exploitation (CSAE), including any material depicting minors in a sexual context.

 

We do not tolerate the use of Showmetoo for the purpose of endangering children. Specifically, promoting exploitative behavior is prohibited, including:

 

- inappropriate actions towards children (e.g., fondling or groping);

 

- the lure of minors, such as meeting and communicating with a child online for the purpose of committing sexual acts (online or offline) and/or exchanging sexual images with them;

 

- sexualization of minors, such as material depicting, inciting, or encouraging child sexual abuse, or depicting children in a manner that could lead to their sexual exploitation;

 

 - blackmail through sexual disclosures (e.g., threatening or blackmailing a child based on real or imagined access to their intimate photographs);

 

- child trafficking (e.g., inviting and engaging a child in activities leading to their subsequent commercial sexual exploitation).


We maintain a zero-tolerance policy for child sexual abuse and exploitation material
 (CSAEM). Where required by law, we report suspected CSAEM to the National Center for Missing & Exploited Children (NCMEC) and/or law enforcement.

(Bullet terms above hereinafter will be referred to as "Prohibited content").

In the event of detection and real confirmation of user complaints about Prohibited content or by court order, the owner of this account will be warned about the need to remove this content and stop such activities in the Showmetoo service. If this warning is ignored by said user/users within 3 (three) days, access to the said account will be blocked or, if necessary, the account will be deleted without warning and without the possibility of recovery and refund if this account was paid.

6.4. Availability on Different Devices

We may store some aggregated metadata to create Showmetoo features that will work on all your devices.

6.5. Advanced Features

We may use certain aggregated data about how you use Showmetoo to create useful features.

7. Payment Information

At the moment, there is no opportunity to buy or sell anything in Showmetoo , so there is no section with a corresponding description. When paid services become available, such as purchasing memory to expand your Gallery storage in the Showmetoo service or purchasing a premium Showmetoo account, the relevant additions will appear in our Privacy Policy, of which you will be promptly informed.

8. With whom your personal data may be shared

8.1. Other Showmetoo Users

Other users of our Service with whom you choose to share certain information may be located outside the EEA. Please note that by choosing to communicate with such other Showmetoo users, you authorize us to share your personal information with such users on your behalf per this Privacy Policy.

8.2. Law Enforcement Agencies

If Showmetoo receives a court order confirming that a Showmetoo user is a suspect in cases related to Prohibited Content (clause 8.3.), Showmetoo may share the details of said account with the relevant authorities. Let us repeat: the Showmetoo service is created for responsible people who do not wish to harm other people and want Showmetoo users to feel comfortable and safe using our services. We are not interested in what happens within users' accounts if they do not violate paragraph 5.3. on Prohibited Content and we receive no complaints about their account.

9. Your Rights Regarding the Personal Data Showmetoo Process

Under applicable data protection laws, you have rights regarding your personal data in certain circumstances. You have the right to (1) request a copy of any personal data we hold about you and transmit that copy to another controller, (2) delete or amend your personal data, (3) restrict or object to the processing of your personal data, (4) request the correction of any inaccurate or incomplete personal data we hold about you, and (5) complain about us to national data protection authorities in connection with our processing of your personal data. Users, if you do not agree to the Showmetoo minimum requirements for any reason, it will not be possible to provide you with our services. You can delete your Showmetoo account by going to the deactivation page in the mobile application.

10. Data Deletion

10.1. Accounts and Account

If you choose the option of deleting your account, you can do so on the account deletion page in  general settings in the Showmetoo app. Deleting your account will delete all profiles, publications, files, and any other your data stored in the Showmetoo cloud. This action must be confirmed through your Showmetoo account and cannot be undone.

11. Self-deleting Your Account

If a user no longer wishes to use Showmetoo and has not been online for at least 12 months, then the account of this user will be deleted by default along with all publications, files, and any other data of the account.

12. Amendments to this Privacy Policy

This privacy policy may be amended from time to time, and you will be informed about it through the Showmetoo app. Any changes to this Privacy Policy will be effective upon publication of the revised Privacy Policy on www.showmetoo.com

Showmetoo: Terms of Use

1. Legal Information

The translation of this agreement is provided for the convenience of users only. The English version of the document takes precedence, provided that any errors in the translation will not be interpreted in a way that would put the consumer at a disadvantage.

The Terms of Use describe the responsibilities that you undertake when using our services. By using our services, you agree to comply with these Terms of Use and our Privacy Policy. Regardless of your citizenship and place of residence or location, this agreement is concluded between you and Showmetoo.

The Showmetoo service is a public social network that allows its users to:

- pin their profiles to the public map, see the profiles/accounts of other Showmetoo users within a radius of 0 to 70 meters, and exchange messages and media files with them, even if these users don't know each other.

- Publish images and videos with added location (hereinafter referred to as "Posts")

- View other users' posts

- Follow other users and view their profiles

- Save photos and videos, audio files, and certain types of documents (hereinafter referred to as "Files") to the cloud Gallery.

 

After you register with Showmetoo, a profile and account will be created for you, in which you can make posts with files and use Showmetoo’s other features.

After registration, your profile/account and posts will be immediately visible to other users, who will be able to comment on them, react to them, and share them with other users. If you wish, you can hide your profile/account in search and/or leave your posts visible only to your mutual followers.

 

2. Your Files, Content, and Permissions

When you use our services, you are providing us with your data and files - they belong to you alone. These terms do not grant us any rights to your content other than the limited rights that allow us to offer the services.

To access and use our services, you need to register an account with Showmetoo, and we need to create the account for you.

We need your legal permission to host your files, make backup copies of them and, at your request, make them available to others. To provide these and other functions, Showmetoo accesses, stores, and scans your files. You will be permitting us to do these this on your behalf. Your files are yours alone and we guarantee that we will not use your files for our benefit or share them with third parties. We don't care what files you store or publish unless we have received complaints from other users, requests for verification from legislative bodies, or violate our Privacy Policy and Terms of Use.

 

3. Your Responsibilities

Use of our Services must be per the Terms of Use. The data contained in our services may be protected by intellectual property rights. Please do not copy, upload, download, or provide access to data unless you have the appropriate right to do so. We are not responsible for the data that users save, publish, or provide access to using our Services.

Keep your password to our Services confidential. Do not share your account identification data with anyone or provide others with access to your account.

You may use our services only as permitted by applicable law, including export control laws and regulations. Finally, you may only use our services if you are over 18 years of age and reside in the United States or in another country. If the law of your place of residence requires that you be a certain age for Showmetoo to legally provide you with our services without parental consent (including the use of your personal information), then you must be the age specified in local law.


4. Additional Features

We will occasionally add additional features to make our service even more user-friendly, at no additional cost or for a fee, but these free features may be discontinued without notice.

5. Our Content

Our services are protected by copyright, trademark, and other laws of the EU and other countries. These Terms do not grant you any ownership, title, or other rights in or to the services, other people's content posted via the Services, or any trademarks, logos, or other elements of the Showmetoo brand.

6. Copyright

We will respond to notices of copyright infringement claims if such notices are made in compliance with the law. Such notices must be made per our Copyright Policy. We reserve the right to remove or block content that is reported as infringing and to terminate the accounts of users who commit repeated infringements. Copyright infringement complaints should be sent to showmetoo.info@gmail.com

7. Paid Accounts and Services

Currently, our services do not offer paid accounts or features, so this section is not included in the Privacy Policy or Terms of Use. If they appear, you will be promptly informed about this, and the corresponding changes will be made to our Privacy Policy and Terms of Use. Sometimes, you may see third-party advertising on Showmetoo services that doesn't use your personal data or preferences.

8. Technical features, permissions, and main functions of Showmetoo.

At the moment, you can have access to Showmetoo services and your data and files saved by you in the Showmetoo service only if your device through which you want to use our services has a working Internet connection.

Permissions

Showmetoo DOES NOT NEED ACCESS to the following functions of users' smartphones (devices):

- contacts or phone book

- device camera

- microphone

- calls and messages

To make posts and/or save your files on our service, as well as share your location with other users and see other users nearby, you will need to give Showmetoo partial or full access to the files and geolocation on your device.

 

Accounts and Profiles

To register an account, you will need to provide us with your email address and create a password, which we will store in our service so you can use it in the future to log in to your account or recover your password. Showmetoo is not responsible for the security of the password you create. After you register with Showmetoo, a profile and account will be created for you, where you can post media files.

After registration, your profile/account and posts will immediately be visible to other users, who can comment on them, react to them, share them with other users, and follow you. If desired, you can hide your profile/account from search results and/or limit your posts to those you follow.

Notifications.

There is a special section in Showmetoo where you will see notifications about new comments and replies, reactions and new followers.

GALLERY and Saving Files

Each account has a section for cloud storage of user files - GALLERY, in which you can create albums and folders. The GALLERY is visible only to you.

Saving files to the Gallery

You can save up to 5 files to the Gallery at a time, each up to 200MB in size. Photos and videos are processed and automatically reduced in size before saving and publishing. You can minimize the application while saving files, but do not close it, otherwise saving will be interrupted. We will notify you if in the future we add a function to save files without compression and the ability to close the application when saving.

“Share My Presence” function

- after clicking the "Share My Presence" button your profile avatar will be pinned to the map at the location where you were when you clicked it and will be visible to other Showmetoo users within a 70-meter radius, if they are also sharing their presence

- no one but you will see your location until you click the "Share My Presence" button

- other users will not see if you have shared your presence and moved to another location

- when you click the button that determines your geolocation and turns on GPS (pink or gray dot), you will see how many people are nearby and their blurred avatars, but you will not be able to view their profiles until you also share your presence

- after pinning your avatar, the GPS function is not used: even if your device or GPS is turned off, your avatar will remain on the map until the time you selected expires after which it will automatically disappear

- other Showmetoo users won't know you've viewed their profiles unless you've performed any actions on them.

By using Showmetoo services, you agree to allow other Showmetoo users to:

- send you private messages

- view your profile/account without your knowledge

- view your posts

- see the exact location of your device

- see the exact location of your posts

If necessary, you can block other Showmetoo users, preventing them from sending you private messages and viewing your posts and profile. Please keep in mind that if you are concerned that your profile/account may be visible to strangers, users with malicious intent, and/or individuals who may cause you moral, psychological, material, and/or physical harm, please do not use Showmetoo services. The use of any Showmetoo services is entirely the responsibility of the individual user. Any consequences of communication between Showmetoo users are their sole responsibility. By using Showmetoo services, you understand the direct and indirect risks and consequences associated with the visibility of your profile/account to third parties.

9.  Termination of the Service

You can stop using our Services at any time. We reserve the right to suspend or cancel your access to the Services by sending you a notice if we have reasonable grounds to believe that:

- You have violated these Terms of Use or the Privacy Policy,

- You use the services in a way that poses a risk of harm or loss to us or others. You spread falsehoods and publish inaccurate information or information that is not verified and confirmed by official authorities.

We will provide you with reasonable advance notice at the email address associated with your account so that we can correct the action that prompted us to contact you and you can export your content from our services. If, after receiving such notice, you fail to take the action we have requested you to take, we will cancel or suspend your access to the Services.

We will not provide notice or the opportunity to export your Content before terminating or suspending your access to the Services if Showmetoo reasonably believes that: you have committed a material breach of these Terms, including but not limited to a breach of our Acceptable Use Policy. Sending notice would expose us to legal liability or jeopardize our ability to provide the Services to others. We are prohibited by law from doing so.

Once we suspend or terminate your access to the services, you will no longer be able to access or export your Content.

10.  Termination of Services

We take maximum measures to provide you with our services reliably and efficiently.  First and foremost, this is in our utmost interest.  However, since we live in a material world and any material object is prone to aging or deterioration, the provision of ANY digital services and/or services on the Internet always primarily depends on physical (material) machines (servers, computers, software and other equipment) that ensure the operation of these services,  So, we can stop providing our services if EXCEPTIONAL unforeseen circumstances or events arise that Showmetoo cannot foresee and prevent (e.g. natural disasters, military actions, crimes, fires, explosions, complete or partial failure of physical equipment due to hidden technical defects, premature aging or premature wear of equipment responsible for the operation of our services, etc.). In such cases, Showmetoo cannot and will not be held liable for your lost data, but we will inform you within a reasonable time so that you can export your materials from our systems (we will notify you no later than 30 days in advance if the current situation allows it).

 

11.  Services on Unilateral Terms

It is important for us that we understand each other. Your files and data are stored on our cloud servers, access to which depends on many factors (Internet connection, cellular network, cellular coverage, interference, features of your device, distance from the server, etc.). We are forced to include this condition in the Terms of Use to prevent and avoid unpleasant situations for you, such as: in a certain situation, you were unable to use some of your files or data stored in our service and for this reason, suffered any losses (direct or indirect) or did not gain any benefit. Showmetoo will not bear any responsibility for such events. We take all measures so that our service can help you in many other situations that are important to you. To the maximum extent permitted by law, the Showmetoo service does not provide any warranties, express or implied, regarding its services. The services are provided on our unilateral terms, that is, we offer you our terms, and you decide whether to accept them or not. We also do not provide any warranties regarding the quality of our services, suitability for a particular purpose, and non-infringement of rights. In some countries, the disclaimers specified above are not allowed, and in such cases they may not apply to you. We thank you in advance for your understanding.

12.  Limitation of Liability

We will always be the liable party where it is not unlawful to do so: this includes any liability for fraud or fraudulent misrepresentation by Showmetoo and its affiliates in providing services to you. Where such liability is required, we will only be liable for loss or damage that was a reasonably foreseeable result of our failure to act reasonably and professionally or that resulted from our breach of contract between us and you. This paragraph also applies to consumer rights that cannot be limited by any contract or agreement. If you are an EU or UK consumer, these terms also do not exclude Showmetoo's liability for loss that arose from our failure to act reasonably and professionally or that resulted from our breach of contract between us and you provided that such loss was reasonably foreseeable. In those countries where exclusions and limitations of liability are permitted, Showmetoo and its affiliates, suppliers, and distributors will not be liable for any indirect, special, incidental, consequential, punitive, or exemplary damages, or loss of data, use, business or profits, regardless of the laws of such countries. These exclusions apply regardless of whether Showmetoo or its affiliates have been advised of the possibility of such damages or not. 

 

13. Dispute Resolution

We will always be on your side if you do not violate our Terms of Use and Privacy Policy, and we do not want to waste time and effort.  So, if you have any complaints or disputes with us, we will endeavour to  resolve them peacefully, without resorting to litigation. To do this, first send us a written notice to showmetoo.help@gmail.com, stating your name and a detailed description of the complaint or dispute. We will do our utmost to resolve the dispute as quickly as possible in a mutually beneficial manner. If the dispute is not resolved within 60 days of notification, either you or we have the right to initiate formal legal proceedings.

14.  Court to Resolve Disputes.

 Showmetoo and yourself agree that any legal proceedings to resolve disputes related to these Terms or the services will be brought in the District Court of Munich, Germany, subject to the mandatory provisions set forth below. You and Showmetoo each consent to the venue and jurisdiction of such courts. If you live in a country (such as the United States) whose laws may provide consumers with the right to bring up disputes in local courts, this paragraph does not affect those requirements.

15.  No Class or Representative Actions

You may only resolve disputes between yourself and Showmetoo directly, and a third party may not bring a claim on behalf of another person or act as a plaintiff in a class, consolidated, or class representative action. Class arbitrations, class actions, proxy actions, or consolidation of claims in arbitration are not permitted.

16.  Governing Law

These Terms are governed by EU law, excluding its conflict of law provisions. However, some countries have laws that require contracts to be governed by the local laws of the consumer's country. This paragraph does not override such laws.

17.  Entire Agreement

These Terms constitute the entire agreement between yourself and Showmetoo concerning the subject matter of these terms and supersede any other prior or contemporaneous agreements or terms that apply to the subject matter of these Terms. Our past, present, and future affiliates and agents may rely on our rights under this agreement if they become involved in a dispute with you. Otherwise, these Terms do not confer any rights on any third party.

18.  Waiver, Severability, and Transfer

The failure of Showmetoo to enforce any provision will not constitute a waiver of the right to enforce that provision at a later date. If any provision is found to be unenforceable, the remaining provisions of these Terms will remain in full force and effect and the unenforceable provision will be replaced by another provision that comes as close as possible to the replaced provision per our intentions. You may not assign any of your rights under these Terms to anyone. Any attempt to do so will be null and void. Showmetoo may assign its rights to any of its affiliates or subsidiaries, or the successor of any business associated with the Services.

19.  Changes

We may change these Terms to better accommodate:

· Changes in the law

· New regulatory requirements

· Improvements and improvements to our services

If any changes affect your use of the services or your legal rights as a user of our Services, we will notify you before such changes become effective by sending you an email to the email address associated with your account or through a system notification. Such changes will become effective no less than 30 days after we notify you.

If you do not agree to the changes we make, please stop using the Services before such updated terms become effective. By continuing to use or access the Services after such changes become effective, you agree to the updated terms.
